New Study by Petr Bartoň Examines Legal Risks in Czech D35 Highway PPP Evaluation
The Czech Republic (and indeed all of Europe) needs to complete the D35, the second highway corridor linking the east and west of the continent, to relieve the chronically congested D1. In accordance with the government’s program, construction and operation are to be contracted out under a PPP (public private partnership) arrangement. Bids are currently being evaluated in a tender designed to select the bidder with the lowest offered price. According to available sources, it appears that the evaluator is considering the discounted sum of future payments submitted in the tenders as the project’s price. However, this does not reflect the project’s actual price, and thus there is a risk that the evaluation will fail to meet the requirement to “find the lowest price,â€� and legal delays could slow down this entire economically significant project.
The new study by economist Petr Bartoň demonstrates how, based on experience with tendering and lowest-price evaluation, to proceed in a way that truly fulfills the tender’s objective of finding the lowest price.
